FINNS PASS Terms & Conditions

1. Introduction & Acceptance

These FINNS Pass Terms & Conditions (“FINNS Pass T&Cs”) govern your use of the FINNS Pass digital wallet card, the FINNS Pass membership programme, and associated services provided by PT. FINNS Bali (“FINNS”, “we”, “us”, or “our”) at FINNS Beach Club, Jl. Pantai Berawa No. 99, Canggu, Bali, Indonesia.

By registering for a FINNS Pass — whether via our captive WiFi portal, QR code sign-up, the FINNS booking engine, or any other registration method — you acknowledge that you have read, understood, and agree to be bound by these FINNS Pass T&Cs. These terms supplement and should be read in conjunction with the general FINNS Beach Club Terms & Conditions and Privacy Policy, both available at finnsbeachclub.com.

FINNS reserves the right to amend, update, or modify these FINNS Pass T&Cs at any time without prior notice. Continued use of your FINNS Pass following any changes constitutes acceptance of the revised terms. Material changes will be communicated via push notification or email where reasonably practicable.

2. Definitions

  1. “FINNS Pass” means the digital wallet card issued via Apple Wallet or Google Wallet that identifies you as a FINNS Pass member and enables reward redemption, promotional offers, and personalised communications.
  2. “FINNS Pass Membership” means your registration and participation in the FINNS Pass programme, including all associated benefits, rewards, and communications.
  3. “FINNS Pass App” means the web application used to create, manage, and interact with your FINNS Pass.
  4. “Captive WiFi Portal” means the FINNS guest WiFi connection screen operated by our WiFi provider through which registration data may be collected.
  5. “Customer Data Platform” means the platform operated by our technology partner that processes your data for personalised communications and promotional offers.
  6. “QR Code” means the unique quick-response code displayed on your FINNS Pass used for reward redemption and identification.
  7. “Rewards” means any complimentary items, discounts, or promotional benefits made available to FINNS Pass holders, including but not limited to the welcome drink.
  8. “Push Notifications” means mobile notifications sent to your device via your FINNS Pass wallet card or associated communication channels.

3. Eligibility & Registration

3.1 Eligibility

  • You must be aged 16 or over to register for a FINNS Pass, in line with the FINNS Beach Club general entry policy.
  • You must provide a valid email address and accurate personal information at the time of registration.
  • One FINNS Pass per person. Duplicate registrations may be merged or deactivated at our discretion.

3.2 Registration Methods

A FINNS Pass may be created through any of the following methods:

  1. Captive WiFi Portal: Connecting to FINNS WiFi and opting into the FINNS Pass programme during the WiFi registration process.
  2. QR Code Scan: Scanning a FINNS Pass QR code displayed at venue entrance points or within the venue.
  3. Single Sign-On (SSO): Using Apple Sign-In or Google Sign-In where available.
  4. Booking Engine: During or after completing an online booking at bookings.finnsbeachclub.com, where a FINNS Pass may be automatically generated.

3.3 Data Provided at Registration

During registration, you will be asked to provide some or all of the following:

  • Full name
  • Email address
  • Date of birth
  • Gender (optional)

By submitting this information, you confirm that it is accurate, complete, and up to date. You are responsible for updating your details if they change.

4. FINNS Pass Usage

4.1 Digital Wallet Card

  • Your FINNS Pass is stored in Apple Wallet (iOS) or Google Wallet (Android) and is personal to you.
  • Your FINNS Pass contains a unique QR code linked to your account. Do not share, duplicate, screenshot, or transfer your FINNS Pass to others.
  • FINNS reserves the right to reject a FINNS Pass presented as a screenshot, printout, or on a device other than the registered holder’s.
  • You are responsible for maintaining access to your FINNS Pass. FINNS is not responsible for passes lost due to device changes, software updates, or account changes.

4.2 WiFi Access

  • FINNS Pass holders may connect to FINNS guest WiFi by entering their registered email address on the captive WiFi portal.
  • WiFi access is provided on an “as available” basis. FINNS does not guarantee uninterrupted WiFi service, speed, or availability.
  • WiFi usage is subject to FINNS’ acceptable use policies. FINNS reserves the right to restrict or terminate WiFi access at its sole discretion.

4.3 In-Venue Identification

  • Your FINNS Pass may be used for identification purposes within FINNS Beach Club, including but not limited to reward redemption, promotional offer validation, and guest tracking.
  • FINNS staff may request to scan your FINNS Pass QR code at various service points within the venue.

5. Rewards & Promotional Offers

5.1 Welcome Reward

  • New FINNS Pass holders are entitled to one (1) complimentary FINNS Seltzer (or equivalent as determined by FINNS), redeemable at the FINNS Party Drinks Bar upon presentation and scanning of a valid FINNS Pass QR code.
  • The welcome reward must be redeemed on-site during the guest’s visit. It is non-transferable, cannot be exchanged for cash or alternative items, and expires after a single redemption.
  • A valid FINNS Pass QR code must be presented directly from Apple Wallet or Google Wallet on the registered holder’s device. Screenshots or printouts will not be accepted.
  • Once scanned and redeemed, the reward will be marked as claimed on your FINNS Pass and cannot be redeemed again.

5.2 Promotional Offers & Push Notifications

  • FINNS may send you promotional offers, exclusive deals, and in-venue notifications via push notifications to your FINNS Pass wallet card, email, SMS, or WhatsApp.
  • Promotional offers are subject to their own specific terms and conditions, including but not limited to: validity periods, minimum purchase requirements, product exclusions, and redemption limits.
  • FINNS reserves the right to modify, suspend, or withdraw any promotional offer at any time without prior notice.
  • Promotional offers cannot be combined with other offers, discounts, or promotions unless expressly stated.
  • Promotional offers are non-transferable, non-exchangeable, and hold no cash value.

5.3 Spend-Based & Behavioural Offers

FINNS may use data relating to your in-venue spending, visit frequency, booking history, and behaviour to personalise promotional offers sent to you. These offers may be generated and delivered in real time while you are on-site. By accepting these FINNS Pass T&Cs, you consent to FINNS analysing your transactional and behavioural data for the purpose of delivering personalised marketing communications and offers. You may opt out at any time (see Section 7.5).

5.4 Offer Abuse & Fair Use

  • FINNS reserves the right to void, cancel, or reverse any reward or promotional redemption where it reasonably suspects fraud, system manipulation, abuse, or exploitation of a technical error.
  • Creating multiple accounts to claim additional rewards or circumvent redemption limits is strictly prohibited and may result in permanent deactivation of all associated FINNS Passes.
  • FINNS is not liable for rewards that cannot be redeemed due to system downtime, technical errors, stock limitations, or venue capacity constraints.

6. Account Management & Deactivation

6.1 Account Integrity

  • You are responsible for the security of the email address and device associated with your FINNS Pass.
  • You must not create a FINNS Pass using false or misleading information.
  • If FINNS detects duplicate accounts for the same individual, it may merge or deactivate accounts at its discretion without prior notice and reserve the right to refuse offers. 

6.2 Deactivation by FINNS

FINNS reserves the right to suspend or permanently deactivate your FINNS Pass at any time, without prior notice, for any reason including but not limited to:

  • Breach of these FINNS Pass T&Cs or the general FINNS Beach Club Terms & Conditions.
  • Fraudulent activity, abuse of rewards or promotional offers, or attempted system manipulation.
  • Provision of false, inaccurate, or misleading personal information.
  • Conduct that is threatening, abusive, or disruptive to FINNS staff, guests, or operations.
  • Inactivity for a period exceeding 24 months.

Upon deactivation, all unredeemed rewards and accumulated benefits are immediately forfeited without compensation.

6.3 Voluntary Opt-Out

You may request deactivation of your FINNS Pass and deletion of your FINNS Pass membership at any time by contacting [email protected]. Deactivation will be processed within 30 business days, subject to any legal data retention requirements.

7. Data Collection, Privacy & Consent

7.1 Data Controller

FINNS Bali is the data controller responsible for your personal data collected through the FINNS Pass ecosystem. For data protection inquiries, contact [email protected].

7.2 Personal Data We Collect

Through your use of the FINNS Pass, we may collect and process the following categories of personal data:

Registration Data:

  • Name, email address, date of birth, gender

Device & Technical Data:

  • Device type, operating system, wallet type (Apple/Google), WiFi connection logs, IP address, browser type

Transactional Data:

  • In-venue purchases and spending data (via POS systems), booking history, package selections, add-on purchases

Behavioural & Engagement Data:

  • Visit frequency and duration, reward redemption history, push notification interactions, promotional offer engagement, in-venue location data (where applicable)

Communication Data:

  • Email engagement (opens, clicks), SMS/WhatsApp delivery and response data, push notification interactions

7.3 How We Use Your Data

Your personal data is collected and processed for the following purposes:

  1. To create, manage, and maintain your FINNS Pass account and membership.
  2. To deliver and validate rewards and promotional offers.
  3. To authenticate your identity at service points within FINNS Beach Club.
  4. To provide and manage WiFi access.
  5. To send you personalised marketing communications, promotional offers, and in-venue notifications via push notification, email, SMS, or WhatsApp.
  6. To analyse your transactional and behavioural data for the purpose of personalising offers and improving your guest experience (customer segmentation and profiling).
  7. To generate aggregated, anonymised analytics for venue operations, marketing performance measurement, and business planning.
  8. To comply with legal obligations under Indonesian law.

7.4 Legal Basis for Processing

We process your personal data on the following legal bases as provided under Indonesia’s Law No. 27 of 2022 on Personal Data Protection (“PDP Law”):

  1. Consent: You provide explicit consent when you register for a FINNS Pass and accept these FINNS Pass T&Cs. You also provide consent for marketing communications and personalised offers.
  2. Contractual Necessity: Processing is necessary to deliver the FINNS Pass services you have requested, including reward fulfilment and account management.
  3. Legitimate Interest: Processing for venue security, fraud prevention, and aggregated analytics where such processing does not override your fundamental rights.
  4. Legal Obligation: Processing required to comply with Indonesian laws and regulations.

7.5 Marketing Communications & Opt-Out

By registering for a FINNS Pass, you consent to receive marketing communications from FINNS via push notification, email, SMS, and WhatsApp. You may withdraw your consent and opt out of marketing communications at any time by:

  1. Removing your FINNS Pass from your digital wallet (this disables push notifications).
  2. Clicking the “unsubscribe” link in any marketing email.
  3. Replying “STOP” to any SMS or WhatsApp marketing message.
  4. Contacting [email protected] with your opt-out request.

Please note that opting out of marketing communications does not deactivate your FINNS Pass. Transactional messages (such as booking confirmations and account notifications) are not marketing communications and will continue to be sent where necessary.

7.6 Data Sharing & Third-Party Processors

We may share your personal data with the following categories of third-party service providers who process data on our behalf and under our instruction:

  1. WiFi Infrastructure Provider: To provide and manage captive WiFi portal registration and access.
  2. Customer Data Platform Provider: To manage customer profiles, deliver personalised communications, segment audiences, and automate marketing journeys.
  3. Digital Wallet Provider: To generate, issue, and manage your FINNS Pass digital wallet card.
  4. Booking Engine Provider: To manage bookings, reservations, and associated guest data.
  5. Middleware & POS Integration Provider: To synchronise transactional data between in-venue point-of-sale systems and the customer data platform.
  6. Communication Service Providers: To deliver email, SMS, and WhatsApp messages.
  7. Analytics & Reporting Tools: To generate aggregated performance reporting and business intelligence.

All third-party processors are contractually obligated to process your data in accordance with our instructions and applicable data protection laws. We do not sell your personal data to third parties.

7.7 International Data Transfers

Some of our third-party service providers operate outside of Indonesia. Where your personal data is transferred internationally, we ensure that appropriate safeguards are in place as required under the PDP Law, including contractual data processing agreements that require the receiving party to maintain equivalent levels of data protection.

7.8 Data Retention

We retain your personal data for as long as your FINNS Pass account remains active, plus an additional period of up to 24 months following account deactivation or your last interaction with FINNS, unless a longer retention period is required by law. Transactional records may be retained for up to 5 years for tax and accounting compliance purposes under Indonesian regulations. Aggregated, anonymised data that does not identify you may be retained indefinitely for analytics and business planning.

7.9 Your Rights

Under Indonesia’s PDP Law, you have the following rights in relation to your personal data:

  1. Right of Access: You may request access to the personal data we hold about you.
  2. Right of Correction: You may request correction of inaccurate or incomplete personal data.
  3. Right of Deletion: You may request deletion of your personal data, subject to any legal retention requirements.
  4. Right to Withdraw Consent: You may withdraw your consent for data processing at any time. Withdrawal of consent does not affect the lawfulness of processing carried out prior to withdrawal.
  5. Right to Restrict Processing: You may request restriction of processing of your personal data in certain circumstances.
  6. Right to Data Portability: You may request a copy of your personal data in a structured, commonly used, and machine-readable format.
  7. Right to Object: You may object to the processing of your personal data for direct marketing purposes.

To exercise any of these rights, contact [email protected]. We will respond to your request within 30 business days. We may require verification of your identity before processing your request.

7.10 Data Security

We implement appropriate technical and organisational measures to protect your personal data against unauthorised access, alteration, disclosure, or destruction. These measures include encryption of data in transit, access controls, regular security assessments, and contractual obligations on third-party processors. However, no method of electronic storage or transmission is entirely secure, and FINNS cannot guarantee absolute security of your data.

7.11 Data Breach Notification

In the event of a personal data security breach that is likely to result in a high risk to your rights and freedoms, we will notify the relevant supervisory authority and affected individuals in accordance with the timeframes and requirements set out in the PDP Law.

8. Cookies, Tracking & Automated Decision-Making

8.1 Cookies & Similar Technologies

The FINNS Pass web application and related web services may use cookies, pixels, and similar tracking technologies to recognise returning users, analyse usage patterns, and improve service delivery. By using these services, you consent to the use of such technologies as described in our Cookie Policy (available at finnsbeachclub.com).

8.2 Automated Profiling & Segmentation

FINNS uses automated profiling and customer segmentation through its customer data platform to categorise guests based on booking type, spending behaviour, visit frequency, and engagement patterns. This profiling is used to determine which promotional offers and communications you receive. Automated profiling does not produce legal or similarly significant effects on you. 9. Intellectual Property

  • The FINNS Pass and all associated branding, logos, designs, QR codes, and content are the intellectual property of PT. FINNS Bali and its licensors.
  • You may not reproduce, distribute, modify, reverse-engineer, or create derivative works from any FINNS Pass materials or technology without prior written consent.
  • The FINNS Pass QR code and wallet card are licensed to you for personal, non-commercial use only.

10. Limitation of Liability

  1. FINNS Pass services are provided on an “as is” and “as available” basis. FINNS does not warrant that the FINNS Pass, FINNS Pass web application, push notifications, WiFi access, or reward redemption systems will be uninterrupted, error-free, or free from technical faults.
  2. FINNS is not liable for any loss, damage, or inconvenience arising from: inability to access or use your FINNS Pass; failure of push notifications to deliver; WiFi service interruptions; technical errors in reward redemption; third-party system failures; or loss of data.
  3. FINNS’ total aggregate liability to you under these FINNS Pass T&Cs, whether in contract, tort, or otherwise, shall not exceed the value of any unredeemed rewards on your FINNS Pass at the time of the claim, or IDR 500,000, whichever is less.
  4. Nothing in these FINNS Pass T&Cs excludes or limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under Indonesian law.

11. Indemnity

You agree to indemnify and hold harmless PT. FINNS Bali, its directors, officers, employees, agents, and affiliates from and against any claims, losses, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from or in connection with: your breach of these FINNS Pass T&Cs; your misuse of the FINNS Pass; any fraudulent or illegal activity conducted using your FINNS Pass; or your provision of false or misleading personal information.

12. Force Majeure

FINNS shall not be liable for any failure or delay in performing its obligations under these FINNS Pass T&Cs where such failure or delay results from circumstances beyond its reasonable control, including but not limited to: natural disasters, acts of God, pandemic, epidemic, government actions, power outages, internet or telecommunications failure, cyberattacks, or third-party service provider outages.

13. Children & Minors

The FINNS Pass is available to individuals aged 16 and over, consistent with the FINNS Beach Club entry policy effective 1 May 2025. Individuals under 16 may not register for or hold a FINNS Pass. Where a guest is aged 16 or 17, we encourage parental or guardian awareness of these terms. FINNS complies with applicable Indonesian regulations on the protection of minors in electronic systems.

14. Governing Law & Dispute Resolution

  1. These FINNS Pass T&Cs are governed by and construed in accordance with the laws of the Republic of Indonesia.
  2. Any dispute arising from or in connection with these FINNS Pass T&Cs shall first be resolved through good-faith negotiation between the parties.
  3. If a dispute cannot be resolved through negotiation within 30 days, it shall be referred to and finally resolved by arbitration administered by the Bali International Arbitration and Mediation Centre (BIAMC), or if unavailable, the Indonesian National Board of Arbitration (BANI), in accordance with their applicable rules.
  4. The seat of arbitration shall be Bali, Indonesia, and proceedings shall be conducted in English.

15. General Provisions

  1. Severability: If any provision of these FINNS Pass T&Cs is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
  2. Entire Agreement: These FINNS Pass T&Cs, together with the FINNS Beach Club general Terms & Conditions and Privacy Policy, constitute the entire agreement between you and FINNS regarding the FINNS Pass.
  3. No Waiver: Failure by FINNS to enforce any provision of these FINNS Pass T&Cs does not constitute a waiver of that provision or the right to enforce it.
  4. Assignment: FINNS may assign or transfer its rights and obligations under these FINNS Pass T&Cs to any affiliate, successor, or third party without your consent. You may not assign your rights under these FINNS Pass T&Cs.
  5. Language: These FINNS Pass T&Cs are drafted in English. In the event of a conflict between any translated version and the English version, the English version shall prevail.
